1. TERMS OF USE

These terms of use (‘Terms’) set out the terms on which you may use our website at hourofwrites.com (“Website”), whether as a visitor or as a registered user. By using the Website, you indicate that you accept these Terms and that you agree to abide by them. If you use the Website as an employee or representative of another legal entity, by using the Website, you indicate that you accept these Terms on behalf of yourself and such legal entity. If you do not agree to these Terms, please refrain from using the Website.

The Website is operated by Hour of Writes Limited (“HOUR OF WRITES”, “we”, “us”), a limited company registered in the United Kingdom, with registration number 8904533, and whose registered address is at 83 Ducie Street, Manchester, M1 2JQ.

3. ACCESS TO THE WEBSITE

You are responsible for making all arrangements necessary for you to have access to the Website.

You must treat any password you have for use of the Website as confidential, and you must not disclose it to any third party. You are responsible for any use of the Website (other than by our Website administrators) using your login details, including your email address and password.

We may suspend access to the Website, or withdraw the Website, at any time for any reason at our discretion, including for any maintenance or upgrading of the Website. From time to time, we may also restrict access to some parts of the Website, or the entire Website, to users who have registered with us (‘Registered Users’).

If you breach, or we reasonably suspect that you are in breach of, any of these Terms, we may immediately and without notice terminate your use of the Website, or any part of the Website.

HOUR OF WRITES and its licensors are the owners of all such intellectual property. Except as expressly set out in these Terms or the Hour of Writes Writing Competition Rules (see paragraph 12), you shall have no rights in respect of any such intellectual property rights. Note: The Hour of Writes Writing Competition Rules set out the copyright position in respect of all competition entries. Users own copyright to their own Notes on the site which are given a private status. (“Notes” are the notes which a User makes on the Website and which can be given public or private status by the User.

You may download information from the Website for your own private use only. You may not otherwise copy, adapt, modify, distribute, create derivative works of or use for any personal purpose any content on the Website, in whole or in part, without first obtaining the written authorisation of HOUR OF WRITES and, where necessary, its licensors.

5. LINKING TO THE WEBSITE

You may link to the Website home page from any website owned by you, or social media profile used by you provided that you do so in a way that is fair and lawful and the link does not damage HOUR OF WRITES’s reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on HOUR OF WRITES’s part where none exists, and the Website must not be framed on any other website.

6. LINKS FROM THE WEBSITE

The Website may, from time to time, contain links to other sites and resources provided by third parties. These links are provided for your information only. You acknowledge that HOUR OF WRITES has no control over the availability or contents of those sites or resources, does not endorse them, and accepts no responsibility for them or for any loss or damage that may arise from your use of them.

You may not make any unlawful or unauthorised use of the Website, including by introducing any virus or other malware or causing any denial of service attack; or attempting to gain unauthorised access to the Website, the server on which the Website is stored or any server, computer or database connected to the Website.

8. VIRUS PROTECTION

Although care is taken to check and test material at all stages of production, HOUR OF WRITES cannot accept any responsibility for any loss, disruption or damage to your data or your computer system which may occur whilst using material derived from the Website.

9. DISCLAIMERS

HOUR OF WRITES has tried to ensure that the contents and information it provides on the Website are accurate at the time of posting. Unfortunately it cannot guarantee the accuracy of contents or information contained in its pages and any person using information contained in them does so entirely at their own risk.

We cannot guarantee that the Website will operate continuously or without interruption or be error free.

We will not be liable for any loss or damage caused by a denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment and content embodied on it as a result of your use of the Website.

10. USER-GENERATED CONTENT

10.1 You agree that you will not post material that contains content which is threatening, abusive, harassing, defamatory, offensive (racially, sexually, ethnically, on religious grounds or otherwise), promotes a political view or is otherwise objectionable in our opinion.

10.2 You will not post or transmit chain letters, pyramid or money schemes.

10.3 You will not use your email account to impersonate any person; and/or 'spam' by posting frequent and/or annoying (in our opinion) messages.

10.4 Material that you post must not contain links to sites that open up multiple windows or to sites that contain material that would fall within clause 10.1 above.

10.5 You agree that you will not post content, the display of which would infringe the intellectual property rights of any third party. In particular, you represent and warrant that the content of your posting is original and not copied from any third party.

10.6 You agree that you will not use postings to offer items or services for sale or place advertisements for goods, products or services of third parties.

10.7 If you breach any of the provisions set out in this clause HOUR OF WRITES may immediately terminate your use of the Website.

10.8 HOUR OF WRITES reserves the right to remove and/or not to publish any material that you post in its absolute discretion.

10.9 You consent to HOUR OF WRITES monitoring your posting prior to distribution.

10.10 You consent to HOUR OF WRITES editing any posting it receives from you for the sole purpose of formatting to make it legible or correcting any spelling mistakes or obvious errors.

10.11 The views and opinions expressed in the user-generated content on the Website are not those of HOUR OF WRITES and no endorsement is made by HOUR OF WRITES of the accuracy or completeness of the content. You should not rely on the content.

11 INFORMATION ABOUT YOU AND YOUR VISITS TO THE WEBSITE

We may collect and process information about you when using the Website in accordance with our Privacy Policy. By using the Website, you consent to such processing.

Whilst we take reasonable care in compiling and presenting the content of the Website, we give no representation or warranty that the content is at any time complete, accurate or up to date, and we are under no obligation to update any content.

We may also change these Terms at any time. You are expected to refer to these Terms from time to time and to take notice of any changes we have made. By continuing to use the Website after any such changes have been made, you agree to such changes. Some of the provisions contained in these Terms may also be superseded by provisions or notices published elsewhere on the Website.

If any court or competent authority finds that any of these Terms is invalid, illegal or unenforceable, that term shall, to the extent required, be deemed to be deleted, and the validity and enforceability of the other terms shall not be affected.

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with English law, and the English courts will have non-exclusive jurisdiction in respect of any such dispute or claim.
